The argument is about the substance of the changes, not the existence of competing forks. BSV may follow the original protocol more closely, but that does not give BTC Core the right to misrepresent BTC as the original Bitcoin if it has fundamentally deviated.
Finally, note that I'm not saying BSV isn't bitcoin but rather BTC Core cannot rely on the existence of BSV or other forks to defend against a passing off claim. The issue at hand is whether they are misrepresenting BTC as the original Bitcoin while making significant changes that alter its essence. The fact that other versions of Bitcoin exist does not absolve BTC Core from the responsibility to accurately portray what BTC is and whether it remains faithful to Satoshi Nakamoto’s original vision.
