One of the problems is that a judge cannot try a case on a part of the law in which they have not been examined. Most of our lawyers have purposely NOT been taught Constitutional Law. Any case that uses the Constitution MUST have a judge Constitutionally trained. I don’t expect the Magistrate knows any Constitutional law. Many Judges today will even tell you that there is no English Constitution. We do have one, it is just not codified.
